It’s now some five years that Rezistans ek Alternativ filed a lawsuit against the State on the mandatory declaration of one's ethnicity for registering as a canditate for the general elections in Mauritius.
The mini constitutional amendment that allowed Rezistans ek Alternativ and Mauritian citizens to participate in the 2014 election was supported in the National assembly by 67 out of 69 MPs.
However, on the eve of the 2019 elections, Pravind Jugnauth overturned this 2014 amendment; you recall that at the last election , the 20 candidates of Rezistans ek Alternativ refused to disclose their ethnicity when registering as candidates for the election. The Election Commission rejected their candidacy.
Ashok Subron had affirmed then that ” Li pa zordi, me nou sir li pou dime. Okenn arierer pa pou kapav anpes lalimier ek la mars listwar."
The Supreme Court took up the case on Monday, September 13 and it it will be up to the Supreme Court to decide whether or not to set up a full bench to listen to this Constitutional case on its merits.
